Highlights from EPA’s fracking hearing in New York

Hundreds of people showed up in Binghamton yesterday (September 13), representing a full range of interests – from those who would support a full-on ban on fracking, to those who want to be sure we have a full understanding of the risks and how they might be managed if fracking gets a green light here, to those who believe drilling in New York’s Marcellus Shale promises much-desired revenue that can’t come fast enough.  Although passions on this issue run very high, the assembled were respectful and the overall tone was measured.  EPA should be commended for running the meeting in a way that helped keep the discourse civil and the comments, for the most part, on the substance. — Switchboard (NRDC staff blog)

On one end of the street where the Environmental Protection Agency session was held Monday stood a few hundred anti-drilling people — about half the crowd of some 500. They held signs like “Protect Our Water Stop Fracking America,” referring to the EPA study to determine the effect of the horizontal drilling method of hydraulic fracturing or “fracking” on drinking water. The anti-drillers heard speakers like Josh Fox, the Honesdale (PA) director of the film, “Gasland” say, “The”» EPA’s mission is to stop fracking now.”  A few hundred feet away, separated by TV crews from CNN, CBS and even Norway, stood a smaller crowd of a few dozen pro drillers. They held signs like “America’s Energy: Natural Gas.” — Times Herald-Record
“They have never done a hydraulic fracking study as comprehensive as the one now beginning,” says Scott Anderson, a senior policy adviser for the Environment Defense Fund. “The results of this study will inform future congressional decisions on whether to continue to exempt hydraulic fracturing from the federal Safe Drinking Water Act.” — Christian Science Monitor
Instances across the country, including some in Northeastern Pennsylvania, have occurred in which drinking water has been tainted in the vicinity of gas wells. That the damage was caused by fracking, and not inadequate well casings, surface spills or other reasons, has not been proven beyond a reasonable doubt, according to gas drilling supporters.

John Harmon of the New York-New Jersey African American Chamber of Commerce said full development of the Marcellus Shale would create 280,000 jobs over the next 10 years, jobs sorely needed in the black community. “This is not the time to further limit energy job opportunities for those in need,” Harmon said. — Associated Press
The industry is increasingly concerned by signs that the EPA is taking seriously the concerns of drilling critics that fracking puts drinking water at risk. On Friday, the API organized a conference call and publicized a study highlighting that if drilling in the Marcellus Shale — which stretches from New York to West Virginia — begins in 2011 under a middle-range scenario, production could reach 9.5 billion cubic feet a day in 2020, generating more than 180,000 jobs and almost $4 billion in additional tax revenue.– Wall Street Journal

NJ’s late season crop of green legislation


Returning to Trenton from a prolonged vacation that began before July 4 and extended through the November 4 election, state lawmakers have already introduced a truckload of new environmental legislation–much of it addressing the hot areas of energy conservation and alternative energy production.

Although few of the bills have a chance to be enacted during the remaining weeks of the current lame duck session, they’ll all be ready for consideration when the Senate and Assembly reconvene for a new two-year session in early January.

Here are just a few of the more than 50 new green bills introduced since November 23:

A-4179 Milam, M.W. (D-1); Albano, N.T. (D-1) Allows construction of wind dependent energy facilities within 500 feet of mean high water line of tidal waters under certain circumstances.
[Translation: on boardwalk piers]

A-4181 Coyle, D.M. (R-16) Requires energy monitoring systems to be installed in new commercial buildings; allows credit against corporation business tax and gross income tax for costs of purchasing and installing energy monitoring systems.

A-4182 Coyle, D.M. (R-16) Permits developer to qualify for low interest loan from NJEDA when building new green housing.

A-4184 Coyle, D.M. (R-16) Authorizes county colleges and county vocational school districts to establish green job certification programs.

A-4185 Coyle, D.M. (R-16) Creates a green building competition.

A-4186 Coyle, D.M. (R-16) Provides gross income tax exclusion for income earned by completing qualified energy efficient and renewable energy job training.

A-4193 Burzichelli, J.J. (D-3) Establishes standards for fertilizer application to turfgrass systems.

A-4195 Coyle, D.M. (R-16) Establishes six-month paid green internship program in Department of Community Affairs.

A-4235 Vainieri Huttle, V. (D-37) Allows independent institutions of higher education to be eligible for NJ alternative fuel vehicle rebate and alternative fuel infrastructure programs.

A-4238 Wagner, C. (D-38) “Plastic Carryout Bag Reduction Act.”

S-3004 Sarlo, P.A. (D-36) Changes the scope of public notification regarding contaminated site remediation.

S-3013 Singer, R.W. (R-30) Requires State entities to purchase biofuels in place of fossil fuels when it is reasonable, prudent and cost effective to do so.

S-3022 Smith, B. (D-17) Requires EDA to establish a “High Performance Green Building Demonstration Project.”

S-3039 Smith, B. (D-17) Requires eligible applicants for innocent party grants from “Hazardous Discharge Site Remediation Fund” to own subject property through application process.

S-3041 Smith, B. (D-17) Imposes certain conditions on NJPDES permit for energy generation facilities that withdraw water from, or discharge water to, a shallow lagoonal estuary

S-3105 Van Drew, J. (D-1) Requires BPU to provide same financial incentives for purchase and installation of wind technologies as for solar technologies.

NJ enviro group backs Christie for governor

No that’s not a typo in the headline.

The New Jersey Environmental Federation (NJEF), one of the largest enviro-activist organizations in the state has endorsed not only a (gulp) Republican for governor but (double-gulp) one who served in the federal government under Bush/Cheney.

Yes, we’re talking about Chris Christie.

Surprised? Amazed? And maybe a bit baffled?
We are, too.

It was one thing for the Sierra Club to endorse former NJDEP Commissioner Chris Daggett’s independent campaign for governor. But it’s another for the NJEF, which had originally announced it would make no endorsement in the race, to come out for Christie.

What’s going on? We don’t know. But here’s a theory.

The state’s other big enviro group, the Sierra Club, didn’t just stop with their endorsement of Daggett. Its leader went on, in press release after press release, to rip incumbent Democratic Governor Jon Corzine’s environmental record.

The pounding culminated in the astonishing claim that Corzine is
the worst environmental governor in history.

Whoa! Did they forget all about Christie (Honey, I shrunk the DEP) Whitman and Jim “fast track development” McGreevey?

Is this the same Jon Corzine who the rest of us have seen signing one environmental bill after another? The governor who got out ahead of virtually all other states in setting aggressive goals for greenhouse gas reductions. The guy who has backed cap-and-trade, solar-energy incentives and offshore wind power development?

And, even if the Sierra Club wasn’t satisfied with Corzine’s record, it’s one thing to back another candidate to display your convictions but totally another to flay a sitting governor who just might win re-election. That, we submit, is just plain dumb.

So, our theory continues, rather than risk seeing the governor’s office door slammed on the environmental community for the next four years, it might be a good idea for the other big green group to back the other major candidate…even if he is a Republican friend of Karl Rove.

There’s one tiny weakness to the strategy. Corzine could win.

Then what happens?

The enviros may be counting on the fact that Jon can’t seem to repress a single “progressive” reflex. They may have good reason to suspect that, after a decent interval for sulking, he’ll succumb to let’s kiss and make up.

But what if the governor has been in New Jersey long enough now to adopt a more native political reaction? You know, the one called: Piss me off and see who wins.

Should New Jersey require prevailing wage for any private real estate projects?

The question in the headline above was posed
by NJBIZ to New Jersey’s Democrats and Republicans.

The business publication said it received no response from the Democrats. The Republican response, sent by Assemblyman Michael J. Doherty, was:

“The government has no business dictating how much people should be paid, whether it’s a private real estate project or a state-funded green energy job. Prevailing wage requirements do nothing but drive up costs for consumers, and send a message to small businesses, in particular, that they aren’t needed in New Jersey, and should look for opportunities in other states.

“For example, in July, Gov. Jon S. Corzine signed a new law mandating prevailing wage for any construction project funded by the New Jersey Board of Public Utilities. The law is another attack on the small-business community, ratepayers and, in this case, the environment, as it will drive up costs for clean energy projects just to curry favor with representatives of organized labor.

“Such legislation would have similar effects in the private sector, and is the last thing New Jersey needs — especially now, when companies are fleeing our state because of its anti-business climate. “

PA’s budget fix: Drop college and tuition funding?

Pennsylvania legislators are so terrified by the prospect of raising taxes that they’re actually preparing to vote tomorrow on a new state budget that contains no funding for some universities and student loan programs.

Will Joe Paterno be flipping burgers this fall instead of prowling the sidelines? No, the educational funding cuts will not affect the four state-related universities – Penn State, Temple, Pittsburgh, and Lincoln – because their money comes from an annual appropriation outside the general fund.

But if you’re a student at West Chester or Cheney State universities or at any of Pennsylvania’s state community colleges–or a recipient of a state tuition loan, well…fries with that sir?

The brain trust in the Democratic House has proposed removing the educational funding from the budget but replacing it, at some future date, with a “dedicated funding source,” possibly the state’s take from video poker or some other scheme yet to be devised.

In other words, some other revenue source that doesn’t start with T and rhyme with ax.

Governor Rendell calls the proposal: ““exactly the kind of bold and creative thinking we need to solve big challenges.”

Even guys as smart as Ed Rendell say some pretty silly things when their state budget is already two weeks late and, unless signed tomorrow, will cause more than 33,000 angry state workers to receive only part of their usual paycheck.

Senator Smith saves recycling — in New Jersey

Recycling in New Jersey–once a national model–had been on a down slide for years until the state Legislature, despite significant opposition, passed legislation last year that re-imposed a recycling tax on garbage.

When Governor Corzine signed the legislation into law, the state’s recycling community was elated and re-energized. Recycling coordinators knew that revenue from the tax would go into a dedicated state fund and would be used to support local recycling efforts–based on how successful each county and town was in removing cans, bottles, paper and other ‘recyclables’ from the
waste stream.

Recycling coordinators began planning ways to pump up their programs. Some ordered new equipment. Some entered into agreements with commercial recyclers for single-stream pickups which eliminate the need for residents and businesses to separate paper from metal and metal from glass. Others laid out plans for new educational and collection plans in schools and for tougher enforcement efforts to insure compliance.

Then along came the state budget crunch. In a last-minute strategy to balance the current fiscal year’s budget–as the Legislature was working out final details on next year’s FY 2010 spending plan–the Corzine Administration pushed through a supplemental appropriations bill that transferred money from a number of existing program accounts into the General Fund.

Part of that re-appropriation included grabbing $7 million from the state’s newly revitalized Recycling Fund.

The reaction of municipal and county recycling coordinators, who were counting on the money to pay for programs and equipment they had already committed to, ranged from consternation to near panic. Then Bob Smith stepped in.

Smith, a veteran state legislator from Middlesex County, is the Democratic chairman of the Senate Environment Committee and a long-time supporter of recycling.

He was the sponsor in the Senate of the legislation that refunded the recycling program and author of a ‘poison pill’ provision within the bill that basically said the money could only be used for recycling.

Recognizing that previous Administrations, in times of budget stress, have ignored such legal limitations, Smith made a personal plea to Governor Jon Corzine. He explained the benefits of recycling and the reasons for the ‘poison pill’ language. He then told the governor: “If you allow this to happen, you will kill recycling in New Jersey.”

What followed sounds like a Hollywood ending. The governor listened and was persuaded. He promised Smith that his staff would look elsewhere for the $7 million.

An amazing story, but true. Thanks to Senator Smith, recycling in New Jersey has been saved–again.
