HARTFORD, Conn. (Legal Newsline) – The Connecticut Supreme Court upheld the dismissal of a medical-monitoring lawsuit on behalf of workers who had been exposed to asbestos during a reconstruction project, saying they failed to provide enough evidence showing they’d suffered some type of injury from the incident.

The decision delicately sidesteps the question of whether Connecticut law allows medical-monitoring claims at all, with the justices saying there was no need to decide the issue at this time. It was enough for the trial judge to determine that plaintiff experts failed to raise a question of fact about whether the workers needed to be monitored for future signs of asbestos-related disease, the court said.

“Although medical monitoring is no longer a novel theory of recovery in many states, whether such recovery is permitted in Connecticut is still an open question of law,” Chief Justice Richard Robinson wrote in a unanimous decision originally issued last September and published June 29. “Even if we were to recognize a medical monitoring claim in the absence of any physical manifestation of injury under Connecticut law, the plaintiffs nevertheless failed to establish a genuine issue of material fact as to certain elements of the claim, in particular, whether the provision of medical monitoring is reasonably necessary for them.”

Danny Dougan sued Sikorsky Aircraft, now a unit of Lockheed Martin, and others in 2012 following a 2009 incident in which he and other workers discovered they had been working on a power-plant reconstruction site that contained small amounts of asbestos in some of the insulated pipe. Dougan’s lawyers formed a proposed class action on behalf of all the workers on the site, seeking money for medical monitoring to detect any future signs of asbestos-related disease.

The defendants moved for summary judgment, saying the plaintiffs didn’t supply any evidence they had been injured and it was against public policy for Connecticut courts to recognize a claim for medical monitoring in the absence of physical harm. Only Dougan submitted a medical report and even his expert, M. Saud Anwar, acknowledged “a significant percentage of people who are exposed to and inhale asbestos …never develop clinical symptoms.”

The trial judge granted the motion in March 2017, saying no expert had examined the medical records of any other plaintiffs and no one had been diagnosed with an asbestos-related disease. Dougan died of apparently unrelated causes before the end of the year, eliminating the only plaintiff with any medical evidence at all. 

The plaintiffs appealed, saying the trial court incorrectly concluded Connecticut doesn’t allow claims for medical monitoring in the absence of physical injury.

Juvenile Atlantic Sturgeon making a comeback in the Hudson River?

A recently published article in the North American Journal of Atlantic Fisheries Management indicates that the Hudson River juvenile stock may be recovering, particularly in recent years.

The article was written by DEC’s Hudson and Delaware Marine Fisheries biologist Rich Pendleton and Robert Adams (Bureau of Fisheries) using annual juvenile abundance (population) monitoring data from 2004 – 2019. The article describes a slow, but significant increase in catch rates of juvenile Atlantic sturgeon since monitoring began in 2014.

 Data show the average catch rate of juvenile sturgeon in recent years (2012-2019) is two times higher than that observed during the first eight years (2004-2011) of monitoring. Overfishing, bycatch, ship strikes, and habitat loss and alteration severely depleted the Atlantic sturgeon stock over the course of 200 years. Although state managers along the Atlantic Coast imposed fishing regulations to reduce harvest or completely closed their fisheries, the stock continued to decline, prompting a 1998 coast-wide moratorium on harvest imposed by the Atlantic States Marine Fisheries Commission.

However, this meant information collected from harvested fish and the commercial fishing industry was no longer available to track population trends over time. State managers needed to establish other ways to monitor the depleted stocks. In 2003-2005, DEC and US Fish and Wildlife Service developed a fisheries-independent survey to monitor the abundance of juvenile Atlantic sturgeon in the Hudson River. This survey was one of the first to establish relative abundance estimates of juvenile Atlantic sturgeon following recovery recommendations established by the Interstate Fishery Management Plan (PDF) for Atlantic sturgeon.

Fisheries biologists in DEC’s Hudson and Delaware Marine Fisheries unit have continued to annually sample using anchored gill nets to capture juvenile sturgeon in Haverstraw Bay, an overwintering area for these young fish. The recently published article uses abundance data collected from this survey.

Atlantic sturgeon is a late-maturing species and females may not spawn for the first time until the age of 15. Therefore, protected sturgeon spawned after the 1998 moratorium would only begin to return and spawn in the Hudson River in the early 2010s. This helps explain why data indicates the average catch rate of juvenile sturgeon from 2012-2019 is twice as high as that observed during the first eight years (2004-2011) of monitoring, suggesting the Hudson River stock may be recovering in response to the coast-wide fishing moratorium. The results from the survey also showcase the need for long-term, fisheries-independent monitoring to document abundance trends in slow-maturing, long-lived species such as Atlantic sturgeon.

General Motors has taken steps to secure lithium, a crucial ingredient for electric vehicle (EV) batteries, sourced in the US through a strategic investment and partnership with Australia’s Controlled Thermal Resources (CTR), which is developing a project poised to become the country’s largest by 2024.

The deal, announced on Friday, will see GM investing “multi-millions” into CTR’s Hell’s Kitchen geothermal brine project near California’s Salton Sea, roughly 160 miles (258 km) southeast of Los Angeles.

The automaker did not disclose the exact investment figures but said the move makes it one of the first to develop its own source of the battery metal.

The company will have first rights to lithium produced by the first stage of the project, including an option for a multi-year deal going forward if CTR’s extraction process proves successful.

The announcement comes as both the Biden administration and US-based automakers seek to speed up the development and adoption of cleaner lithium extraction methods and increase the domestic supply of the white metal. 

“By securing and localizing the lithium supply chain in the US, we’re helping ensure our ability to make powerful, affordable, high mileage EVs while also helping to mitigate environmental impact and bring more low-cost lithium to the market as a whole,” Doug Parks, GM executive vice president, global product development, purchasing and supply chain, said in the statement

The Hell’s Kitchen project is expected to begin producing lithium in 2024. That output would be used in GM’s Ultium battery cells, which are being manufactured as part of a joint venture with LG Energy Solution, after undergoing validation and testing.

Sheep may safely graze with solar overhead

Sheep graze through the tall prairie grass, their bleats breaking the quiet as butterflies and insects flit through the native flowers.

The pastoral setting is not a restored prairie. It’s a solar installation in rural Chisago County — one of the 16 in Minnesota run by Enel Green Power, a global renewable energy company based in Rome that supplies Xcel Energy.

In Minnesota, at least, the solar farms are generating more than electricity. Instead of turf, bare ground or gravel, the land beneath Enel’s Minnesota installations were all seeded with native pollinator-friendly grasses, sedges and wildflowers. They’ve matured into rich native habitats for bees, insects and butterflies — in a landscape desperately short of them.

Minnesota state agencies, such as the Public Utilities Commission, Department of Natural Resources and the Board of Soil and Water Resources all encourage such plantings at solar sites as a matter of policy.

“One of the fastest-growing trends in solar, nationwide, is doing better than turf grass under and around the panels,” said Rob Davis, director of the Center for Pollinators in Energy at the St. Paul nonprofit Fresh Energy. That could be food or other types of vegetation.

Minnesota pioneered standards for what constitutes pollinator-friendly vegetation at solar sites — similar to standards for organic products — following legislation in 2016 to prevent greenwashing or false environment-friendly claims, Davis said.

The Monarch Joint Venture in St. Paul is among the groups studying the results.

Laura Lukens, the group’s national monitoring coordinator, has been at several Enel sites with her clipboard this summer taking inventories of the quality and abundance of flowering plants and milkweed, and the native pollinators using them. She’s also tracking the difference between the habitats growing directly under the panels vs. the ones in between. Lukens said she’s excited by what she’s seen.

“We’ve been seeing great things in terms of the floral community and the pollinators using the habitat there,” Lukens said. “I saw monarchs breeding at every site I visited.”

A group of songbirds recently turned up dead in Nottingham, Chester County.

But their cause of death is a mystery for scientists, wildlife officials, and bird lovers. Scores of similar bird deaths have been reported in 27 Pennsylvania counties, including Philadelphia, since June. And more and more deaths have been logged in Delaware and eight other states and Washington, stretching back to April.

Officials and wildlife experts are stumped by the illness and deem the rash of deaths unusual. They are pleading with the public to stop feeding birds from feeders and providing water in birdbaths until the cause is found, as they believe congregating birds may contribute to the malady’s spread.

The illness is killing a range of species, all of which have been found with ocular and neurological issues. The disorder is marked by swollen eyes with a crusty discharge, and erratic flight and stumbling.

Officials say cases have been reported in Tennessee, Kentucky, Virginia, West Virginia, Maryland, Indiana, Ohio, and Florida.

Lisa Murphy, a veterinarian and associate professor at Penn’s School of Veterinary Medicine, called the illness “worrisome.” She is co-director of Penn’s Wildlife Futures Program and director of the Pennsylvania Diagnostic Laboratory System at New Bolton Center in Kennett Square, Chester County. The lab has been performing autopsies and toxicology tests on affected birds and is coordinating with labs and wildlife centers in other states.

The New Jersey Board of Public Utilities this week awarded two new contracts to offshore wind companies to construct the next phase of a planned massive wind farm out in the Atlantic Ocean, off the coast of South Jersey.

Nevertheless, questions remain about the financial impact of the project on ratepayers, and how hundreds of giant wind turbines will affect tourism along the shore and impact schools of fish and whales out in the ocean.

The group Save our Shoreline has collected more than 10,000 signatures opposing the state’s wind farm plan, in part because it is expected to increase the cost of electricity in the near term, but no one is sure by how much.

When BPU President Joe Fiordaliso was asked what kind of an increase is anticipated for the average Jersey home or business, and how long the higher rates would be in effect once the wind farm project was constructed in 2035, he said “clean energy costs money, there’s no getting around it, however as time goes on those costs diminish.”

He said an example of this is in the solar industry, where costs are half of what they were 14 years ago.

“When we look at the clean energy industry we also have to look at the economic benefits that we’re getting, the thousands of jobs that are being created,” Fiordaliso said.

He noted we should take into account the infusion of billions of dollars into the New Jersey economy from this kind of undertaking.

“We will be the supply chain for the entire east coast as far as offshore wind is concerned,” he said. “So you can just imagine the amount of money, the amount of economic enhancement that’s going to occur.”

Fiordaliso said when we’re talking about a shift to clean energy we need to consider up-front cost but also the economic benefit that will follow.

When asked about concerns that the electromagnetic field created by the wind farm may disrupt the migration of fluke and other fish and cause problems for whales that rely on sonar to navigate the seas, he said the BPU is working “with our friends in Europe
